Terms of Service

Malney is an online real estate marketplace for Ghana. Realtors use Malney to list and manage properties, and customers use it to discover properties, contact realtors, schedule viewings and make payments.

Malney provides the platform. Unless we say otherwise in writing, Malney is not a party to any agreement between a customer and a realtor, and we do not own, inspect or guarantee the properties listed.

To create an account you must be at least 18 years old, or have the legal capacity to enter into binding agreements under the laws of Ghana.

You agree to:

• provide accurate and up-to-date information;
• keep your password and sign-in methods secure;
• tell us immediately if you suspect unauthorised use of your account; and
• accept responsibility for everything done through your account.

You may browse Malney without an account. A free account lets you like properties, follow realtors, send inquiries, request viewings and place orders.

• Be honest in your inquiries, orders and reviews.
• Verified Interest is a paid enquiry that shows a realtor you are serious. Its fee is displayed before you confirm, and it does not guarantee that a property will be available to you.
• Always view a property and check the documents before you pay for it.

To publish properties you must apply to become a realtor, submit the required identity and property documents, pay the one-time application fee and be approved by our team. The application fee is non-refundable, whatever the outcome.

As a realtor you agree to:

• list only properties you are authorised to market;
• keep listings accurate, current and free of misleading claims;
• respond to customers honestly and promptly;
• stay within the listing capacity of your subscription plan; and
• comply with all applicable laws and regulations.

We may review, reject, hide or remove listings, and may suspend or end a realtor account that breaks these Terms or repeatedly receives very poor ratings. A suspended realtor may submit an appeal from their profile.

You keep ownership of the content you post, such as photos, descriptions, reviews and messages. By posting it you give Malney a non-exclusive, worldwide, royalty-free licence to host, display, promote and distribute it on and in connection with the platform.

You must not post content that is false, infringing, offensive, discriminatory or unlawful, or that you do not have the right to share. We may moderate, edit or remove content at our discretion.

Ratings and reviews must reflect a genuine experience. Reviews may not contain links, personal data, hate speech or abuse. We may remove reviews that break these rules and may act on accounts that manipulate ratings.

Some features carry fees, including the realtor application fee, subscription plans, listing add-ons, prepaid lead packages, Verified Interest and promotions. Prices are shown in Ghana cedis (GHS) before you pay and may change from time to time. The price displayed at checkout applies.

Payments are processed by our payment partner, Paystack. Malney does not store your card details. Fees are non-refundable unless we state otherwise or the law requires it. If you believe you were charged in error, contact us with your payment reference.

Promotions and third-party campaigns are reviewed before they run and are clearly labelled as sponsored. Advertisers are responsible for the accuracy and legality of their content, and Malney does not necessarily endorse the products or services advertised.

You must not:

• commit or attempt fraud, or misrepresent who you are;
• harass, threaten or discriminate against others;
• collect data from Malney with automated tools without our written permission;
• bypass or interfere with our security, payments or fees;
• upload malware or disrupt the service; or
• use Malney for any unlawful purpose.

You may stop using Malney at any time. We may suspend or terminate access, hide listings or remove content if we believe you have broken these Terms, put others at risk or harmed the platform. Where appropriate we will tell you why and, for realtors, explain how to appeal.

The Malney name, logo, design and software belong to Malney or its licensors. These Terms give you a limited, revocable right to use the platform for its intended purpose, and nothing more.

Malney is provided “as is” and “as available”. We work hard to keep listings accurate and the platform secure, but we cannot guarantee that listings are free from error, that every realtor will perform as promised, or that the service will always be uninterrupted. Please verify important details yourself before you commit to any transaction.

To the fullest extent permitted by law, Malney is not liable for indirect or consequential losses, or for losses arising from dealings between customers and realtors. Nothing in these Terms limits liability that cannot be limited under the laws of Ghana.

We may update these Terms from time to time. When we make important changes we will update the date at the top of this page and, where appropriate, tell you. Continuing to use Malney after changes take effect means you accept the new Terms.

These Terms are governed by the laws of the Republic of Ghana. Any dispute will be handled by the competent courts of Ghana, after we have first tried in good faith to resolve it with you.
